Terms of Service for Spark – Story Craft Dices

1. About these Terms

These Terms of Service (“Terms”) form an agreement between you and BetaZetaDev (“we”, “us” or “our”), based in Spain, concerning your download, installation and use of Spark – Story Craft Dices (“Spark” or the “App”).

By downloading, installing, purchasing content in or using Spark, you confirm that you have read and agree to these Terms. If you do not agree, do not use the App. If you downloaded Spark from Apple’s App Store or Google Play, your use is also subject to the applicable store terms. Mandatory consumer rights and store terms prevail where they cannot lawfully be changed by this agreement.

Our Privacy Policy explains how information is processed in connection with Spark and forms part of the conditions governing your use of the App.

2. The App

Spark is an entertainment and creativity application that uses illustrated dice to inspire stories. Its main functions operate on your device and do not require an account. Spark does not currently provide a social network, user-to-user interaction or a platform-hosted library of user stories.

The free version includes a basic dice pack. Optional premium dice packs are available as individual, one-time in-app purchases. Spark does not currently offer subscriptions, recurring payments, credits, virtual currency, loot boxes or randomised purchases.

3. Eligibility and minors

You must be legally capable of agreeing to these Terms. If you are below the age of legal majority where you live, you may use Spark only with the permission and supervision of a parent or legal guardian. A parent or guardian who permits a minor to use Spark is responsible, to the extent permitted by law, for supervising that use and authorising purchases.

Spark is intended for a general audience. Parents and guardians should use the purchase approval and parental-control features available through Apple, Google and the device. Nothing in this section limits protections that applicable law provides to minors.

4. Licence to use Spark

Spark is licensed, not sold. Subject to these Terms and the applicable app-store usage rules, we grant you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to install and use Spark on devices you own or control, solely for personal, non-commercial entertainment.

The licence continues while Spark is made available and you comply with these Terms. It does not transfer ownership of the App or any BetaZetaDev content. Rights not expressly granted are reserved by us and our licensors.

Where mandatory law permits additional uses, including certain acts of interoperability, backup, quotation or reverse engineering, nothing in these Terms excludes those rights.

5. Premium dice packs

Each premium dice pack is a separate, one-time in-app purchase. A completed purchase gives you a licence to use that pack within Spark; it does not give you ownership of, or commercial exploitation rights in, its illustrations, icons, designs or other assets.

Purchases are associated with the Apple or Google account used to buy them and are validated and restored using the relevant store and RevenueCat. Restoration requires successful verification and may require the same store account, an internet connection and a supported version of Spark. We cannot guarantee that purchases made through one platform will be recognised on a different platform unless Spark expressly supports that feature.

There are no recurring charges for a pack. Before confirming a purchase, the store displays the applicable price, currency and taxes.

6. Payments, restoration and refunds

All payments are submitted through Apple In-App Purchases or Google Play Billing under the terms associated with your store and payment account. BetaZetaDev does not receive or store your full payment-card details.

If a purchased pack is not unlocked, first use Spark’s restore-purchases function with the account that made the purchase. You may then contact us with the store, product and transaction details reasonably needed to investigate. Do not send payment-card information.

Refund eligibility is governed by applicable law and the relevant store rules:

Apple generally administers refunds for Apple transactions. Google or BetaZetaDev may process a Google Play refund where the platform rules permit. Nothing in these Terms excludes a statutory refund, withdrawal, conformity or consumer-guarantee right. If a purchase is refunded, reversed, cancelled or found to be fraudulent, access to the corresponding pack and its related benefits may be withdrawn.

7. Advertising

Users without a valid premium pack may see occasional interstitial advertisements. Spark does not currently use banner ads, rewarded ads or ads that must be viewed to unlock content.

Purchasing any one premium pack removes advertising from Spark for the purchasing account, provided the purchase remains valid and can be verified on a supported device. Advertising may reappear if a purchase is refunded or revoked, verification fails, the wrong store account is used, or purchases have not yet been restored. Advertising and related privacy choices are further explained in the Privacy Policy.

Third-party advertisements may lead to external products or services. Their availability, claims and transactions are controlled by the relevant advertiser or provider. We do not endorse every advertised product and are not party to transactions you enter into with an advertiser.

8. Your stories

Stories and narrative ideas that you create using Spark are created by you. We do not claim ownership of your original stories. Spark does not upload, store, analyse or share their content as part of its current functionality.

You are solely responsible for what you create, save, publish or share outside the App and for ensuring it is lawful and does not infringe another person’s rights. Spark’s dice results are creative prompts and may produce coincidental similarities. We do not guarantee the originality, suitability or legal clearance of a story.

Your rights in a story do not include rights in Spark’s dice illustrations, interface, packs, trademarks or other App assets. You may describe or refer to a dice result in your own story, but may not extract or redistribute our visual assets without permission.

9. Acceptable use

You must not, and must not assist another person to:

  • use Spark for an unlawful, fraudulent or rights-infringing purpose;
  • copy, extract, scrape, reproduce, sell, sublicense or redistribute premium packs, illustrations or other App assets;
  • circumvent or manipulate purchase validation, entitlement, advertising, security or technical restrictions;
  • modify, adapt, translate, reverse engineer, decompile, disassemble or attempt to derive Spark’s source code, except to the extent expressly permitted by mandatory law;
  • distribute a modified or unauthorised version of Spark;
  • interfere with the App, stores, RevenueCat, advertising services or related infrastructure, or introduce malicious code;
  • remove or alter copyright, trademark or ownership notices; or
  • use Spark or its assets to build, train or market a competing content pack or product without our written permission.

Violation may result in suspension or termination of the licence and may expose you to legal remedies. Termination does not remove mandatory consumer rights relating to a lawful purchase.

10. Intellectual property

Spark and its source code, object code, architecture, interface, text, illustrations, icons, dice, packs, graphics, audiovisual elements, trade names, logos and visual identity are owned by BetaZetaDev or its licensors and are protected by intellectual property and other applicable laws.

No use of Spark grants you a right to exploit these elements commercially or use our marks in a way that suggests sponsorship, affiliation or endorsement. Third-party names and marks remain the property of their respective owners.

If you believe content in Spark infringes your intellectual property rights, contact us with sufficient information to identify the work, the allegedly infringing material and the basis of your claim.

11. Updates, changes and availability

We may provide updates, fixes, new packs and new or modified functionality. Updates may be required for compatibility, security, purchase verification or continued use. Your store settings may download updates automatically.

We may modify, suspend or discontinue a feature, pack or the App for operational, security, legal or business reasons. Where reasonably possible and legally required, we will give advance notice of a material adverse change. We do not guarantee that Spark or every feature will remain available indefinitely, work on every device or remain compatible with every operating-system version.

If discontinuation affects paid digital content, any remedy will be determined in accordance with mandatory consumer law, the relevant store terms and the circumstances. Nothing in this section permits us to avoid obligations for content already purchased.

12. Third-party services

Spark relies on services supplied by Apple, Google and RevenueCat for distribution, purchases and entitlement validation, and may use Google services for analytics, consent and advertising. Those services are governed by their own terms and may experience outages or changes beyond our reasonable control.

Links or advertisements may lead to third-party sites or services. We do not control their content, security, availability or practices. Review their terms and privacy notices before using them or making a transaction.

13. Support

We will use reasonable care in providing Spark and investigating reproducible purchase or technical issues. Support does not include guaranteed response or resolution times unless mandatory law requires otherwise. You are responsible for maintaining a compatible device, operating system, connectivity and store account.

14. Statutory rights, warranties and disclaimers

Nothing in these Terms excludes or limits warranties, remedies or consumer rights that cannot lawfully be excluded. In particular, consumers in the European Economic Area and United Kingdom retain mandatory rights concerning digital content, conformity and remedies under the law applicable to them.

Subject to those rights, Spark is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that Spark will always be uninterrupted, error-free, secure or compatible with every device, or that creative prompts will meet a particular expectation.

Spark is an entertainment and creativity aid, not professional, educational, medical or legal advice. You remain responsible for how you use or rely on its prompts.

15. Limitation of liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.

To the fullest extent permitted by law, BetaZetaDev and its licensors will not be liable for indirect, incidental, special or consequential loss, loss of profit, business opportunity, goodwill or data arising from your use of or inability to use Spark, where such loss was not reasonably foreseeable when you accepted these Terms.

Where liability may lawfully be capped, our aggregate liability arising from Spark will not exceed the greater of the amount you paid for Spark purchases during the 12 months preceding the event giving rise to the claim or EUR 50. This cap does not apply where prohibited by law. You should maintain appropriate device backups; Spark is not a storage service for stories.

16. Termination

You may end this agreement at any time by stopping use and uninstalling Spark. We may suspend or terminate your licence if you materially or repeatedly breach these Terms, use Spark fraudulently or unlawfully, or create a security risk. Where appropriate, we will give notice and a reasonable opportunity to remedy the breach.

On termination, you must stop using Spark and its licensed content. Sections that by their nature should survive—including intellectual property, disclaimers, liability, governing law and dispute provisions—will continue to apply. Store-administered rights and mandatory consumer remedies remain unaffected.

17. Apple App Store terms

If you obtained Spark from Apple’s App Store:

  • these Terms are between you and BetaZetaDev, not Apple, and BetaZetaDev is responsible for Spark and its content;
  • your licence is limited to Apple-branded products you own or control and is subject to the App Store Usage Rules and permitted Family Sharing or volume-purchase use;
  • Apple has no obligation to provide maintenance or support for Spark;
  • if Spark fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the App, if any, to the extent required by its rules; to the maximum extent permitted by law, Apple has no other warranty obligation regarding Spark;
  • BetaZetaDev, not Apple, is responsible for addressing claims relating to Spark, including product liability, regulatory or consumer-protection claims, and claims that Spark infringes a third party’s intellectual property rights;
  • you represent that you are not located in a country subject to a US Government embargo or designated as supporting terrorism and are not listed on a US Government prohibited or restricted-party list; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section against you upon your acceptance.

Apple’s Standard Licensed Application End User License Agreement also applies to the extent incorporated by the App Store terms. If there is a conflict, mandatory law and the applicable App Store terms control.

18. Governing law and disputes

These Terms are governed by Spanish law. If you are a consumer, this choice does not deprive you of mandatory protections under the law of the country where you habitually live.

Before starting formal proceedings, please contact us and allow us a reasonable opportunity to resolve the dispute informally. Consumers may bring proceedings before the courts competent under applicable consumer law. Where the law permits an exclusive agreement and you are not acting as a consumer, the courts of A Coruña, Spain, will have exclusive jurisdiction.

The European Commission’s former Online Dispute Resolution platform was discontinued on July 20, 2025; these Terms do not direct consumers to that inactive service.

19. Changes to these Terms

We may update these Terms to reflect changes in Spark, providers, law, security or business practices. We will publish the revised Terms and update the date above. Where required, we will give reasonable advance notice in the App of material changes and seek renewed acceptance.

Changes will apply prospectively from their effective date. Continuing to use Spark after receiving legally adequate notice means that the updated Terms apply; if you do not agree, stop using the App. A change will not retroactively reduce rights already acquired through a completed purchase where prohibited by law.

20. General provisions

If a provision is invalid or unenforceable, it will be interpreted as closely as possible to its lawful purpose and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer this agreement except where mandatory law permits. We may transfer it as part of a restructuring, merger or sale of Spark, provided your rights are not materially reduced.

These Terms, the Privacy Policy and applicable store terms constitute the agreement regarding Spark and supersede prior terms on the same subject.
